Rules and Regulations

  1. The "My Muskol Memories" contest is held by Schering-Plough Canada Inc. (the "Contest Organizers"). It takes place on the Internet from March 5, 2009 at 00:00:00 (ET) until August 17, 2009 at 23:59:59 (ET) (the "Contest Period").

Eligibility

  1. This contest is open to all Canadian residents who are of legal age in their province or territory of residence. Not eligible are members of the jury, employees, agents, and representatives of the Contest Organizers, or of any company, corporation, trust or other legal entity controlled by or related thereto, their advertising and promotional agencies, suppliers of prizes, equipment, and services related to this contest, and members of their immediate family (brothers, sisters, children, father, mother), their legal spouse or partner and all those with whom the members of the jury, and such employees, agents, and representatives are domiciled.

How to Enter

No Purchase Necessary.

  1. Grand prize and secondary prizes. Follow these steps to enter the contest for a chance to win the grand prize or one of the secondary prizes:
    1. Go to www.muskol.com. On the home page, follow the instructions to access the electronic registration form (the "Registration Form");
    2. Fill out the Registration Form, indicating your name, age, full address (including your postal code), telephone number (including area code), email address, and the correct answer to the mathematical skill-testing question;
    3. Write a story about your "Muskol Memory." This story should be a memory of an real-life incident experienced while camping, hiking, golfing, fishing, hunting, etc.;
    4. Enclose at least one photo or video with your registration form. You can attach up to three photographs and one video. To proceed, click BROWSE to select the file of the photographs and/or of the video you want to submit;
    5. Declare that you have read the contest rules and that you agree to abide by them, including the authorisation granted to the Contest Organizers pursuant to Section 6 of these rules, the conditions of use, and the privacy policy, by checking the appropriate box on the screen;
    6. Click "Submit." A confirmation page will appear and you will be eligible to win the grand prize and secondary prizes.
  2. Registration Requirements.
    1. Your story must be 75–2000 words long;
    2. The photographs submitted must be in JPEG format with a maximum size of 500 KB, 800 pixels (width) by 600 pixels (height) and should be of good quality;
    3. Accepted video formats are MOV, MPEG, and AVI. For best results, convert your file to MPEG4 video with MP3 sound. Videos can be a maximum of 2 megabytes. The minimum length of the recording is 10 seconds;
    4. The content must meet the following criteria, otherwise you may be disqualified, at the sole discretion of the Contest Organizers:
      1. The story must be based on a real-life experience and must be verifiable;
      2. The story must be original in that you must be its author or that you must have obtained all necessary rights and authorizations to use it under the terms provided for in these rules. Moreover, the content must not violate any laws or any third-party rights;
      3. The story must be in French or English. It should not invade the privacy of a person, i.e., contain his/her name, image, likeness, or voice, without having obtained the consent of that person and, in the case of a minor, the consent of a parent or legal guardian;
      4. The story must not have inappropriate content, including explicitly sexual, offensive, harassing, discriminatory, defamatory, abusive, malicious, or hateful content, and content that otherwise could affect the general morality of Canadian society. It must not have suggestive images or language or encourage any illegal activity, it must not include any commercial content that promotes a product or service other than those of the Contest Organizers, and it must not include any music protected by copyright;
      5. If the Contest Organizers have reason to believe that the story consists of protected content that is not properly authorized, particularly the music, or if the content does not meet the conditions and requirements of these rules, they have the full discretion to refuse to broadcast the content on the Web site or to withdraw it after it is broadcast, in whole or in part. No notice or explanation will be given to the contestants regarding the broadcast or non-broadcast of their material.
      6. If the Contest Organizers have reason to believe that the story received contains information with regards to adverse events or important side effects, the said Organizer have a legal obligation to divulge the information to the appropriate governmental authorities.
  3. Criteria for selecting the grand prize winner. As stipulated in Section 14, a jury will select the winner of the grand prize among 20 finalists selected at random. The jury will evaluate the story and/or photo(s)/video submitted (the "Content") using the following criteria:
    1. Quality of the story
    2. Originality and relevance of the photo(s)/video in relation to the story
    3. Link with and/or role of Muskol in the story
  4. To be eligible for the contest and for their content to be eligible and eventually broadcast on www.Muskol.com, all contestants shall—for each story, photo and/or video submitted—provide the following authorizations by checking the appropriate box to that effect appearing on the Registration Form:

    release regarding the submitted content

    I give Schering-Plough Canada Inc. and its representatives permission to reproduce, disseminate, publish, distribute, perform in public, and edit the story or photo(s)/video submitted (the "Content"). This authorization is given for worldwide use without compensation and for an unlimited period, for the purposes of this contest or any other purpose related to the activities of Schering-Plough Canada Inc., including without limitation for broadcast in various media including the www.muskol.com Web site, Web banners, or advertising material at points of sale for the promotion of the current contest or future contests, if any, or products of Schering-Plough Canada Inc.. I agree that my first name and place of residence may be used in association with the Content. I declare that the Content submitted is original, that I am the sole author of the Content or that I have received all necessary authorizations and rights to its use under the terms provided herein, and that I am not violating any law or third party rights. Upon request, I undertake to provide Schering-Plough Canada Inc. and its representatives with proof of the authorizations mentioned above. I acknowledge that Schering-Plough Canada Inc. and its representatives assume no liability for the use and broadcast of the Content that I submitted for authorized purposes and that they cannot be held liable for any violation of these conditions or terms of use of the Web site by users. I undertake to reimburse Schering-Plough Canada Inc. and its representatives the amount corresponding to any expenditure incurred by them due to any claim or proceedings arising from the use or broadcast of Content that I submitted. In the event that I win the grand prize, I promise to transfer to Schering-Plough Canada Inc. all rights, including copyrights, which I hold or will hold on the Content and to waive, for the benefit of Schering-Plough Canada Inc., any moral rights that I hold or will hold on the Content.

  5. Secondary Prizes. To enter the contest and to be eligible to win a secondary prize, have a photograph of yourself taken by a representative of the Contest Organizers (the "Muskol Ambassadors") at one of the three shows mentioned below or at any other place in Canada to be visited by the Muskol Ambassadors during the contest:
    • March 5–8, 2009: Montreal RV Show
    • March 18–22, 2009: Toronto Sportsmen's Show
    • March 28–29, 2009: Calgary Outdoor Adventure Show
  6. Once you have been photographed, provide the Muskol Ambassador with your name, gender, email address, city, profile type (fishing, hunting, or camping), receive information from Muskol, and sign the electronic document confirming that you agreed to be photographed. The Muskol Ambassador will give you a photograph number that will allow you, and you alone, to see your photograph on the www.muskol.com Web site. You will receive an email confirming that your photograph is accessible. By viewing your photograph during the contest period, you will be automatically entered to win a secondary prize. If you also want a chance to win the grand prize, follow the onscreen instructions to register as provided for in Section 3.3 and the following sections of these rules.
  7. Limits. Contestants must respect the following limits, failing which they will be disqualified:
    1. One (1) entry per person throughout the contest;
    2. The use of a single email address if a contestant has more than one.

Prizes

Grand Prize

  1. One grand prize will be awarded. The prize consists of a four-day stay for two people in Banff National Park in Alberta. The prize, worth approximately $4,000, includes:
    1. Return airfare in economy class between an international airport located near the winner’s residence and the Calgary, Edmonton or Vancouver airports;
    2. Three (3) nights in double occupancy in a standard room in a hotel to be chosen at the sole discretion of the Contest Organizers;
    3. Renting of a vehicle for 4 days;
    4. $800 in spending money for meals;
  2. The following conditions apply to the trip:
    1. Any costs and expenses, other than those mentioned above as being included, will be the responsibility of the winner and his/her guest, including but not limited to, transportation between the winner’s home and the departure airport, personal insurance, alcoholic and non-alcoholic beverages, taxes, tips, on-site activities, Internet access, local and long distance calls, room service, minibar, security deposit at the hotel if required, personal expenses, and costs of obtaining travel documents, if any;
    2. Subject to the provisions of these rules and availability, the trip must, under pain of forfeiture, be made prior December 31st, 2009 , with the exception of the following periods: the Christmas and New Year's holidays, the school break, Easter, the construction holiday, and any other period that may be conveyed to the winner;
    3. Travel arrangements must be made by the winner at least (30) days in advance with the travel agency designated by the Contest Organizers. The winner must provide the travel agency with the name appearing on his/her passport or identity document used for travelling, and the name and address of the guest who will accompanies him/her. No changes will be accepted once the arrangements are completed;
    4. The winner must have a valid driver's license and any other document required by the rental agency at the destination and must be of legal age required to rent the vehicle. In the event that the winner does not meet the requirements for renting the vehicle, the guest can rent the vehicle if he/she meets the requirements. In the event that neither the winner nor guest meets the requirements, the winner will lose the right to that portion of the prize without compensation;
    5. The winner and guest must travel together;
    6. No compensation will be paid to the winner or his/her guest if any portion of the trip is not used;
    7. The approximate value of the trip is based specifically on the average value of the portion corresponding to airfare and accommodation, an amount that may vary depending on date and place of departure. No compensation will be awarded or can be claimed for this purpose if the value of the prize is lower due to the departure point of the winner and guest;
    8. The winner’s guest must be an adult.

Secondary Prizes

  1. Eighty (80) secondary prizes will be awarded:
    1. Ten (10) family passes, valued at $100 each, for Treego or Arbres en Arbres, valid for two adults and two children under the age of 17. They will be delivered in the form of a gift card. The following conditions apply to the gift card:
      1. the gift card cannot be used more than once, unless otherwise specified by the issuer of the gift card;
      2. the gift card is not redeemable for money in whole or in part;
      3. the gift card is valid for a period of one (1) year from the date of issue and no credit or refund will be awarded if the gift card is not used within the prescribed period;
      4. the winner must comply with all other restrictions and conditions that may be communicated by the issuer of the gift card;
      5. the gift card can not be combined with any other offer or promotion.
    2. Ten (10) Coleman brand backpacks worth approximately $200 each. The style and color of the bag will be decided upon at the sole discretion of the Contest Organizers;
    3. Ten (10) digital cameras, worth approximately $200 each. The brand and model of the camera will be decided upon at the sole discretion of the Contest Organizers;
    4. Fifty (50) kits consisting of a Muskol T-Shirt (size and colour will be decided upon at the sole discretion of the Contest Organizers) and a mini Muskol flashlight, including a battery.

Awarding of Prizes and Drawing

Awarding of the Grand Prize

  1. Drawing. On August 18, 2009, at 13:00, at the Montreal offices of the agency responsible for administering the contest, a random drawing will be held to determine the twenty finalists from among all entry forms received during the contest period in accordance with Section 3 of these rules.
  2. Jury. On August 18, 2009, a jury composed of representatives of the Contest Organizers and the agency responsible for administering the contest will evaluate the Content submitted by the 20 finalists based on the criteria established in Section 5 of these rules in order to choose the finalist who will be declared the grand prize winner.
  3. Odds of winning. The odds of being declared the winner of the grand prize depend on the number of entry forms received in accordance with Section 3 during the contest and subsequently 1/20 according to the criteria established in Section 5 of these rules.

Secondary Prize Drawings

  1. On August 19, 2009, at 13:00, at the Montreal offices of the agency responsible for administering the contest, a random drawing of eighty (80) eligible entries will be held from among all entry forms received during the contest period in accordance with Section 3 of these rules and from among all entry forms received during the contest period in accordance with Section 8. The secondary prizes will be awarded in the order in which they are described in these rules.
  2. Odds of winning. The odds of winning a secondary prize depend on the number of entry forms received during the contest period in accordance with Sections 3 and 8.
  3. There is a limit of one prize per person and per household during the contest period.

Claiming a Prize

  1. To be declared a winner, all chosen contestants must:
    1. be reached by email or by telephone by the Contest Organizers within fifteen (15) days following the decision of the jury in the case of the grand prize winner, and within fifteen (15) days of the secondary prize drawings in the case of a secondary prize winner. Any email notification of a prize having been won that results in a message to the effect that the email could not be delivered will result in the disqualification of the contestant and in a new winner being selected;
    2. have correctly answered the mathematical skill-testing question appearing on the registration form;
    3. in the cases of the grand prize winner or a winner of a secondary prize consisting of a family pass to Arbres en Arbres or Treego, complete and sign a declaration and liability release form (the "Declaration Form"), to the effect that he/she has fulfilled all the requirements of these rules, a release that will be sent by mail, fax, or email by the Contest Organizers and that must be returned within fifteen (15) days of its receipt (the guest of the contestant selected for the grand prize must also sign the Declaration Form);
    4. in the case of the grand prize winner, in addition to the permission already granted pursuant to Section 6 of these rules, assign to the Contest Organizers all rights, including copyrights, it has or may have on the Content; waive any profit received by the Contest Organizers, any moral rights it has or may have on Content and, where appropriate, provide any additional documentation demonstrating that he/she owns all rights in the Content. A statement to this effect will be included in the declaration form;
    5. upon request and in a timely manner, provide a piece of identification with a photograph.
  2. Chosen contestants who fail to comply with any conditions specified in these rules or who do not accept their prize will be disqualified. In the case of a secondary prize, the Contest Organizers may, at their discretion, withdraw a secondary prize or hold a new drawing for the prize until a contestant is selected and declared a winner. If no contestant selected for a secondary prize is declared a winner within sixty (60) days of the new drawing, Contest Organizers have the right to withdraw the secondary prize. For the grand prize, the Contest Organizers may, at their discretion, cancel the grand prize or ask the jury to sit again to select another finalist for the grand prize among the remaining finalists based on criteria established in Section 5 of these rules.
  3. Within two (2) to four (4) weeks after receiving the duly completed and signed declaration form, the organizers will send the secondary prize winners their prize by mail; and in the case of the grand prize winner, the Contest Organizers will contact him/her to provide details of how to take possession of the prize.

General Conditions

  1. Verification. Registration and Declaration Forms are subject to verification by the Contest Organizers. Any Registration or Declaration Forms that are (as the case may be) incomplete, illegible, mutilated, fraudulent, transmitted late, or that have the wrong answer to the skill-testing question, or that are otherwise non-compliant, may be rejected and will not be eligible, as applicable, for registration or for a prize.
  2. Disqualification. The organizers reserve the right to disqualify any person or cancel one or more registrations of a person if he/she participates or attempts to participate in this contest using methods that contravene these rules or that would be unfair to other contestants (ex. plagiarism, infringement of third-party rights, registration beyond the allowed limit, piracy etc ....). Any such person may be reported to the competent judicial authorities.
  3. Operation of the contest. Any attempt to deliberately damage the contest Web site and/or any other Web site linked thereto, or to interrupt the legitimate operation of this contest will be a violation of criminal and civil laws. If such attempts were to be carried out, the Contest Organizers reserve the right to reject the registration of the contestant and to obtain legal redress.
  4. Acceptance of prizes. Prizes must be accepted as described in these rules and shall in no case be wholly or partially transferred to another person, substituted for another prize, or exchanged for money, subject to what is stipulated in the following paragraph.
  5. Substitution of prizes. In the event that the Contest Organizers cannot award a prize (or portion of a prize) as described in these rules, they reserve the right to award a prize (or part of a prize) of similar nature and equivalent value or, at their sole discretion, the monetary value of the prize (or part of the prize) specified in these rules.
  6. Legal disclaimer: use of the prize. By entering this contest, each contestant selected to win a prize releases from liability the Contest Organizers, any company, corporation, trust, or other legal entity controlled by or related thereto, their advertising and promotion agencies, their employees, agents, and representatives for any harm he/she may suffer as a result of the acceptance or use of the prize.
  7. Responsibility of the prize supplier. Each contestant selected for the grand prize or the secondary prize consisting of a family pass to Arbres en Arbres or Treego recognizes, as of the time he/she is declared a winner, that the obligation to provide services and products related to the prize becomes the sole responsibility of the suppliers of services and products contained in the prize.
  8. Warranty of prizes. Each contestant selected for a secondary prize recognizes that the only warranty applicable to a secondary prize, if any, is the usual manufacturer's warranty.
  9. Operation of the Web site and photo taken by the Muskol Ambassadors. The Contest Organizers in no way guarantee that the contest Web site and photographs will be available or functional without interruption during the contest, or that they will be free of error.
  10. Limitation of liability: operation of the contest. The Contest Organizers, any company, corporation, trust, or other legal entity controlled by or related thereto, their advertising and promotion agencies, their employees, agents, and representatives refuse all liability related to a malfunction of any computer equipment, software, or any communication lines leading to the loss or absence of communication with the network or related to any faulty, incomplete, unintelligible, or erased transmission caused by a computer or network and that may limit or prevent any person’s opportunity to participate in the contest. The persons mentioned above also refuse any liability for any damage or loss that may be caused, directly or indirectly, in whole or in part, from downloading any page, software, or other, and from the transmission of any information concerning participation in the contest.
  11. Modification of the contest. The Contest Organizers reserve the right at their sole discretion to cancel, terminate, modify or suspend, in whole or in part, this contest if an event or any human intervention occurs that may alter or affect the administration, security, fairness, or proper conduct of the contest as provided for in these rules and, subject to the approval of the Régie des alcools des courses et des jeux du Québec, if required.
  12. End of participation in the contest. In the event that the computer system is unable to register all the contest entries during the contest period, for whatever reason, or if participation in the contest was to end, in whole or in part, before the date provided for in these rules, the drawings and the sitting of the jury can occur at the discretion of the Contest Organizers using the entries duly registered during the Contest Period or, if necessary, until the date of the event which put an end to the participation in the contest.
  13. Prize limit. The Contest Organizers shall not be forced to award more prizes or to award prizes other than in accordance with these rules.
  14. Limitation of liability: participation in the contest. Any person who enters or attempts to enter this contest releases from all liability and aggress, to hold harmless the Contest Organizers and any company, corporation, trust, or other legal entity controlled by or related thereto, their advertising and promotion agencies, their employees, agents, and representatives, for any damage that might incur as a result of his/her participation or attempted participation in the contest.
  15. Authorization. By entering this contest, contestants selected to receive a prize allow the organizers and their representatives to use, if required, their name, photograph, content, image, voice, place of residence and/or statements regarding the prize for advertising purposes, without any compensation.
  16. Communication with contestants. No communication or correspondence will be exchanged with entrants in this contest other than in accordance with this Regulation or on the initiative of the organizers.
  17. Personal information. Contestants’ personal information gathered during this contest will be used only for the administration of this contest. No commercial or other communication not related to this contest will be sent to the contestant, unless otherwise agreed upon.
  18. Ownership. Registration forms, declaration forms, content and any additional documentation provided to the Contest Organizers, if any, are the property of the Contest Organizers and will not be returned to contestants.
  19. Identification of contestants. For the purposes of these rules, the contestant is the person whose name appears on the registration form; and this contestant will be awarded the prize if he/she is selected and declared winner.
  20. Decision of the Contest Organizers. All decisions made by the Contest Organizers or their representatives regarding this contest, including decisions made by the jury, are final and not subject to appeal, subject to any decision made by the Régie des alcools, des courses et des jeux du Québec, in relation to any matter within its jurisdiction.
  21. Dispute. For Québec residents, any dispute regarding the organization or conduct of a promotional contest may be submitted for a ruling to the Régie des alcools, des courses et des jeux du Québec. Any litigation respecting the awarding of a prize may be submitted to the Régie only in an attempt to reach a settlement.
  22. Severability of the sections. If a paragraph of these rules is declared or judged to be illegal, unenforceable, or invalid by a court of competent jurisdiction, then this paragraph will be considered void, but all other paragraphs that are not affected will be applied to the extent permitted by law.
  23. Language. In case of divergence between the French and the English version of these rules, in the case that an English version is available, the French version will prevail.
